Jonathan Gill - Director

Jonathan was admitted to practice in 1990.  His areas of practice include intellectual property, equity and commercial contracts as well as film and television and media law.

Jonathan is a senior fellow in the Law School at the University of Melbourne where he teaches in the Master of Laws program.  Jonathan has taught a variety of subjects including Commercial Applications of Equity and Internet law and is currently teaching Film and Television Law, Free Speech, Contempt and the Media, Communications Law and Defamation Law and also contributes to the teaching of Entertainment Law.

He provides intellectual property law advice (copyright, designs, trademarks and patents) as well as preparing contracts for multi-party research collaborations, computer software, hardware, multimedia and internet contracts.

Jonathan has extensive experience in advising publicly funded researchers, universities, corporate researchers, technology licensors and technology licensees.

Jonathan was formerly an in-house legal counsel for the Channel 10 television network and Business Affairs Manager of Australian Multimedia Enterprise Limited, the then federal government’s funding body for the multimedia industry.

Recent Experience

At Carrick Gill Smyth and in his previous roles, Jonathan has provided advice in relation to a wide range of issues, including:

  • ownership, licensing and infringement of copyright, patents, trademarks and other forms of intellectual property
  • contractual advice for statutory corporations and government funded entities in relation to research collaborations, contract research, licensing
  • contractual advice for small, medium and large corporations in relation to licensing and leasing of premises, the supply of products and services, the conduct of research and the production of films  and television programs  
  • advice in relation to tortuous liability arising out of the conduct of research and the holding of sporting events and the production of films and 
  • pre-publication advice for a number of commercial television networks and print publications in respect of defamation, contempt and other areas of the law restricting freedom of expression.

He has also:

  • prepared and negotiated a wide range of transaction specific agreements
  • prepared suites of model agreements;
  • analysed risk from a government funded organisation perspective in relation to research investment and publication;
  • provided commercial advice in relation to on line ventures; and
  • prepared submissions to government on a wide range of issues.
